BIO

For over 25 years, Marcia has worked in both the public and private sector as external and in-house counsel in defence, aerospace & security and information technology, including a decade with Public Services and Procurement Canada (PSPC), the central purchasing agent for federal departments and agencies. During her tenure at PSPC, she provided strategic and legal advice to Canada’s largest public sector buyer and for some of Canada’s largest defence and Major Crown procurements.

She is co-leader of the Fasken National Security Group, counsel to Fasken’s Procurement, International Trade & Customs, and Technology, Media and Telecommunications groups, and a member of the Fasken Government Relations team. She is a frequent commentator on government contracts and procurement in the private and public sector.

She is recognized by Lexology as a Legal Influencer and a Featured Expert on Lexology’s Instruct Counsel and by Best Lawyers Canada as a public procurement law expert.

Government customers have very unique data and information protection requirements – influenced not only by law, but also by obligations to protect information as a matter of public safety and national security. Concurrently, governments are also under obligations to disclose government information under access to information/freedom of information laws. This article explains the critical and often non-negotiable requirements and constraints that apply to any supplier who provides information to or receives information from their government customer.
